The 62LMD project highlights a council bias towards secrecy

The recent Carpenters Rd affordable housing DA was considered under IMPACT ASSESSMENT. Council refused Carpenters Rd and stated many reasons that also apply to the 62LMD development. In its February 2024 approval of the Tree Clearing DA for 62LMD, and also the later Lot subdivision DA, council adopted less onerous CODE ASSESSMENT. This is inappropriate. Code assessment is reserved for 'expected development' and for purposes consistent with approvals that already exist for the land. Code assessment does not require public notification. This is how significant DA's for 62LMD were passed without any chance of objection from the public. This is an example of how poorly Noosa council have handled the first few years of this secretive development proposal.

We have been told by council that the amendments currently proposed to the Noosa Plan are having to reconsider the issue of when a development should be IMPACT ASSESSED due to the large volume of submissions from the public on this issue. We all want good, clear, and effective regulation on how council discharges its governance responsibilities.

Page 344 indicates a motion carried at the council general meeting in August 2024. This motion prevents the CEO using delegated authority to approve "An application for a proposed development where more than 30 submissions have been received during the notification part objecting to the proposed development." This obviously requires a notification period, and when triggered implies the decision is referred back to the elected councillors.

To our knowledge the broader issue of CODE vs IMPACT assessment is still being resolved through the process of amending the Noosa Plan.
